ELEMENT warrants that all materials supplied by it are free of defects in materials or workmanship for a period of 1 year from the date of delivery. ELEMENT will, at its option, repair or replace any part of its work which is found to be defective on the condition that the Buyer has complied in full with the payment terms and other conditions as stated in its quotation and order acceptance. THIS WARRANTY IS IN LIEU OF ANY OTHER WARRANTY EITHER EXPRESSED OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY OR SUITABILITY FOR A PARTICULAR PURPOSE. ELEMENT will not be liable for any direct or indirect consequential loss to any third party. This warranty specifically excludes remedy for damage, loss or defect resulting from abuse, modifications by others, improper or inadequate installation, improper or inadequate maintenance or normal wear and tear.
